On January 22, 2019, The City Council adopted Ordinance No. 2019-01which formally established the following programs:

Mandatory Commercial Recycling

The State of California Integrated Waste Management act 1989 (Assembly Bill 939) was passed in response to the increase in waste stream and the decrease in landfill capacity in the State of California. This legislation required cities to reduce the amount of waste that went to landfills to no more than 50% of their total. Subsequently, in October 2011 the recycling of commercial solid waste became law with the passage of Assembly Bill 341. This created the “Mandatory Commercial Recycling Program” that all Cities are required to implement. This program stipulates that effective July 1, 2012 any business or any multi-family residential dwelling of five or more units that generates four cubic yards or more of sold waste per week is required to arrange for recycling services.

Mandatory Commercial Organic Recycling

In October 2014, Governor Brown signed Assembly Bill 1826 requiring businesses to recycle their organic waste. This Bill requires that local jurisdictions implement a “Mandatory Commercial Organics Recycling Program”. Organic waste is defined as food waste, green waste, landscape and pruning waste, non hazardous wood waste, and food-soiled paper waste that is mixed in with food waste. This legislation applies to businesses and multi-family residential dwellings that consist of five or more units (Note: multi-family dwellings are not required to have a food waste diversion program). As of January 1, 2019, businesses that generate 4 cubic yards or more of commercial solid waste per week are required to arrange for organic waste recycling services.

SB 1383

In September 2016, SB 1383 was approved by the Governor. Senate Bill 1383 (SB 1383 entitled Short-lived climate pollutants: methane emissions: dairy and livestock: organic waste: landfills) is intended to reduce emissions of short-lived climate pollutants; the goal is to reduce methane by 40%, hydrofluorocarbon gases by 40%, and anthropogenic black carbon by 50% below 2013 levels by 2030. This bill has a greater reach than just waste disposal, but for our part – it is to reduce the organic (food) waste in landfills.
